Waste electrical and electronic equipment | DEEE II : Your new obligations

January 2015 – After two years of work, the transposition decree on waste electrical and electronic equipment (WEEE) and used electrical, electronic equipment (EEE) was published on August 22, 2014 in the Journal Officiel. It has been applicable since August 23, 2014.

It transposes into French law Directive 2012/19/EU on waste electrical and electronic equipment published in the Official Journal of the European Union on July 24, 2012, known as WEEE II, which repealed the initial directive dating from 2002.

This regulatory framework was completed by the publication, on October 8, 2014, of 5 decrees concerning:
– the household/professional distinction for Electrical and Electronic Equipment (EEE);
– the agent appointed by the producer (with the provision of a model contract);
– distributor take-back;
– the procedure for registration and declaration in ADEME’s register of producers;
– processing procedures and the ADEME processing observation database.

Lastly, a notice to producers published on November 27, 2014 by the Ministry of the Environment and Sustainable Development clarified certain practical procedures for applying the decree, and in particular the equipment falling within the regulatory scope. This document replaces the notice of 10/26/2005. It provides legal certainty for producers and guarantees fair treatment for all players.
